Terms of Service

InstantCampaign is an AI-powered email campaign builder that provides:

• AI image generation from text prompts
• AI text generation for email marketing copy
• Visual email template builder with drag-and-drop editing
• Campaign creation with automated multi-email series generation
• Brand voice configuration and consistency tools
• Team collaboration with role-based access control
• Template library with pre-built and custom templates

You must create an account to use most features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

• Provide accurate and complete information when creating your account
• Keep your password secure and not share it with others
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

You may create an account using email and password or through Google OAuth. One account per email address is permitted.

You agree not to use the Service to:

• Generate spam or unsolicited bulk email
• Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Generate content that infringes on intellectual property rights of others
• Attempt to bypass rate limits, usage quotas, or other restrictions
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated tools to scrape or extract data from the Service
• Impersonate any person or entity, or falsely state or misrepresent your affiliation

We reserve the right to suspend or terminate accounts that violate these terms.

Your Content: You retain ownership of all content you create using the Service, including email templates, text content, and brand configurations. You grant InstantCampaign a limited license to store and process your content solely to provide the Service.

Our Service: The InstantCampaign platform, including its design, code, features, and pre-built templates, is the intellectual property of InstantCampaign and is protected by applicable laws. You may not copy, modify, or distribute any part of the platform without permission.

Content generated by AI through the Service (images, text, email copy) is provided "as is." You should be aware that:

• AI-generated content may not always be accurate, appropriate, or suitable for your purposes
• You are responsible for reviewing and approving all AI-generated content before using it in your campaigns
• AI-generated images may occasionally resemble existing works; you are responsible for ensuring your use does not infringe on third-party rights
• We do not guarantee that AI-generated content will be unique or exclusive to your account

You may use AI-generated content for personal and commercial purposes, subject to the acceptable use policies above.

InstantCampaign offers free and paid subscription plans. Paid plans are billed through Stripe.

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable unless required by applicable law
• We reserve the right to change pricing with 30 days notice to existing subscribers
• If payment fails, your account may be downgraded to the free plan
• You can cancel your subscription at any time; access continues until the end of the billing period

Payment processing is handled entirely by Stripe. We do not store credit card numbers or sensitive payment details on our servers.

To the maximum extent permitted by law, InstantCampaign shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

• Your use of or inability to use the Service
• Any AI-generated content created through the Service
• Unauthorized access to or alteration of your data
• Any third-party conduct related to the Service

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You may terminate your account at any time by deleting it through the account settings page. Account deletion is permanent and will remove all your data.

We may terminate or suspend your account immediately, without prior notice, if you violate these Terms of Service or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination will survive, including intellectual property, limitation of liability, and dispute resolution.
